These General Terms and Conditions of Sale relate to any sale of products offered to the customer.

The items offered for sale are designated by their name and brand for any inert product, or by scientific or common name for living things (fish, plants,). They can be illustrated by photos and videos, with a description for the animals. They are not contractual, because every living being is different.

OF this fact, in no case Aquajolia can not be held responsible if the buyer lend that the animal has neither the shape, sizes, colors as the photo. (Except photo sent before sending).

Promotional offers are valid as long as they are visible on the site, and while stocks last.

In the event of unavailability of a product after the order has been placed, we will notify you by email or telephone. Depending on the customer's choice, we will modify your order.

Any order placed implies acceptance of the general conditions of sale.

The order may validly contain inert or living products.

All data recorded by the site: aquajolia.fr constitutes proof of all transactions as well as agreements by email, and financial transactions.

The customer expressly declares:

- be an adult natural person in full possession of their means, and be able to conclude a contract.

- be in full capacity to accommodate, and take care of animals which he wants to acquire.

Confirmation of the order or delivery note automatically implies acceptance by the customer of these conditions.

Rates are in euros, and all payments must be made in euros.

We reserve the right to change our prices at any time. The customer order placed before the change cannot be modified, if the order is accompanied by its payment.

All Aquajolia livestock products remain its property until full payment of the price.

The payment on the site of an order is made:

The collection of payment takes place at the time of placing the order, which conditions its validity.

Your fish are transported by France express (Geodis), which is a transporter approved by the authorities for the transit of live animals.

They are delivered in 24/48 hours.

So that their transport takes place in the best conditions.

Their transport pocket (bag) is inflated with pure oxygen, and wedged in an insulated box in order to maintain them at an adequate temperature. During winter periods, we add a heat pack.

Prices and delivery conditions:

When you place an order on our site: www.aquajolia.fr, you have the choice between picking up your order directly in the Store (65 rue Pierre Seghers 26800 Portes les Valence), or requesting the shipment of your fish through our approved transporter for the transport of live animals (France express).

Pick up in Store: You are not charged for any preparation or packaging costs.

For shipping with France express, the prices applicable on the website are by weight:

For an insulated box:

- from 0 to 4Kg: € 39

- from 5 to 9Kg: 52 €

- from 10 to 14Kg: 100 €

- 14Kg and more: FREE

This price includes insulated boxes, packaging, as well as the essential equipment for a good transport.

For Professionals a box is equivalent to 39 € of delivery, if the order is more than 500 € the shipping costs are offered to you.

Orders containing live products are in principle dispatched on Monday, Tuesday and Wednesday, for next day delivery. Thursday only can be distributed the departments, which are bordering with our breeding. NO DEPARTURE ON FRIDAY, for animal safety. For delivery, DATE and Hours, contact us, to determine them together.

Please note: Packages must be opened in the presence of the delivery person; any anomalies must be noted and reported on their delivery slip. Then send us an email or call us. However if these conditions are not met, no credit will be given to you.

ACCORDING TO DANGEROUS CLIMATE CONDITIONS FOR ANIMALS THE CARRIER MAY MAY PROHIBIT ALL SENDING.

Living Guarantee:

The fish ordered from Aquajolia are subject to a guarantee in the event of mortality only noted at the time of delivery. Once the fish have been received by the customer, they become their property, therefore under their responsibility.

In case of loss of animals:

-a visible photo is requested of the animals in their mailing bag, and sent by email to: aquajolia@gmail.com.

We will deal with your dispute within 48 hours.

If no claim is made upon receipt of the fish, we will not be able to reimburse you.

Aquajolia cannot be held responsible for delays in delivery, therefore no reimbursement will be made by Aquajolia.

All customers are obliged to accept delivery of live products regardless of the date and time of delivery, even in the event of delay.

For inert products, the customer, in accordance with articles L121-20 of the consumption code, has a right of withdrawal of 7 working days to return the product from the date of delivery of the order. The product concerned should not be opened, and have its original packaging. Return shipping costs will be borne by the customer.

For live products, in accordance with article L.121-20-2 3 of the Consumer Code, the right of withdrawal cannot be exercised.

We guarantee that your personal information cannot be passed on to third parties without your prior consent.

This contract is subject to French law. In case of dispute only the French courts will be competent.
